JUDGMENT / ORDER

Heard learned counsel for petitioner and learned A.G.A. for the State through video conferencing and perused the record.
The present writ petition has been filed by the petitioner for quashing the FIR dated 25.8.2017 registered as Case Crime No. 0165 of 2017, under sections 138(B) of the Indian Electricity Act (Amendment) 2003, P.S. Shahganj, District Allahabad.
Learned counsel for petitioner submits that electricity connection was disconnected by the Electricity Deprtment due to non-payment of bill. Now the petitioner had deposited amount of alleged bill. He has not committed any offence and no offence is made out against the petitioner.
Per contra, learned A.G.A. opposed the prayer for quashing the FIR.
As per F.I.R. the electricity connection was disconnected by the Electricity Department due to non-payment of electricity bill. Even then the petitioner was consuming the electricity by connecting electric wire. From the allegations made in F.I.R. it cannot be said that no cognizable offence is made out against the petitioner.
Considering the facts and circumstances of the case and submissions advanced by the learned counsel for the parties, we do not find it a fit case for quashing the impugned FIR, therefore, the prayer for quashing the same is refused and the writ petition is dismissed.
