In view of death of learned counsel for respondent No.1, fresh notice be issued to respondent No.1 making it returnable on 30th April 2012.

In the meanwhile, learned counsel for the appellant shall take steps for unserved respondent No.2 failing which matter will be dismissed qua unserved respondent No.2.
