1. Rule.
Mr. M.T.M. Hakim, learned advocate for the original claimant - respondent No.1 waives service of notice of rule.
2. This application is for staying operation, implementation and execution of the award dated 22nd September, 2011 passed by the Motor Accident Claims Tribunal (Auxi.) Vadodara in M.A.C.P. No. 779 of 2007. On behalf of the applicant, it is stated that the entire awarded amount with costs and interest has already been deposited by the applicant.
3. We have heard the learned advocate for the applicant and also the learned advocate for original claimant. The amounts deposited shall be disbursed in favour of the claimant as directed by the Claims Tribunal. We also permit the withdrawal of the interest periodically on fixed deposit in favour of the claimants. We also direct the Claims Tribunal to renew the term of the fixed deposit from time to time if this appeal is not heard within the period of five years. With the above direction, this Civil application is disposed of. Rule is made absolute in above terms.
