JUDGMENT / ORDER

Respondent no.1 is the husband of respondent no.2 and hence, respondent no.2 could be treated as the legal heir of the deceased. Accordingly, respondent no.1 is permitted to be deleted at the instance of Mr. M.S. Shah learned counsel for the applicant.
The application stands disposed of in terms of the order dated 24.11.2011. Rule is made absolute to the above extent with no order as to costs.
