Heard learned counsel for the appellants and perused the note for speaking to Minutes. In the judgement dated 19.12.2011, passed in First Appeal No.2286 of 1992 by this Court, it is clarified that the original claimant shall be entitled for compensation of Rs.3,37,500/- as against Rs.4,46,500/- as awarded by the Tribunal, with interest at the rate of 12% per annum from the date of filing of the application till realization. However, the Tribunal has awarded total compensation Rs.4,46,50/-. Hence, the excess amount of Rs,1,09,000/- shall be refunded to the Insurance Company with proportionate costs and interest at the rate of 12% per annum.
With the above clarification, the Speaking to Minutes is disposed of accordingly.
