Heard learned advocate Mr. Parikh on behalf of appellant.
Considering submission, appeal is admitted.
ORDER IN CIVIL APPLICATION NO. 10260/2009 Rule returnable on 30/10/2009.
Ad interim relief in terms of para 6(i) on condition that appellant applicant shall have to deposit entire awarded amounts together with costs and interest before Claims Tribunal, Bharuch on or before returnable date. After realizing said amount from appellant applicant insurance company, it is directed to claims Tribunal, Bharuch to pay 30% amount by A/c payee cheque in name of Nitinbhai Nanubhai Kamdar after proper verification. It is made clear to claims Tribunal not to disburse or pay A/c payee cheque except Nitinbhai Nanubhai Kamdar personally and rest of amount is to be invested in any Nationalized Bank with cumulative interest in name of respondent claimant, but FDR is to be remained with Nazir of claims Tribunal, Bharuch, which would require periodical renewal till appeal is finally decided by this Court.
