1. Admit.
2. So far as Civil Application for stay is concerned, pursuant to the Order dated 09.04.2012, it was directed by this Court that the amount awarded by the tribunal shall be invested, and disbursement shall not be made to either side.
3. Mr.
M.J. Shelat, learned advocate for the applicant-appellant, on instruction states that the said order is complied with and the amount awarded has already been deposited before the concerned Tribunal.
4. In above view of the matter, the concerned Tribunal is directed to invest the awarded amount deposited by the applicant-appeallant herein before said Tribunal in any nationalized Bank in fixed deposit in the name of 'Nazir' of the said Tribunal, initially for the period of three (3) years and the said period shall be extendable till the final disposal of the main appeal, on the condition that no loan or any premature withdrawl of the amount lying in the F.D.R shall be permitted by the Tribunal.
5. The Civil Application for stay stands disposed of, however, Mr. Shelat, learned advocate submitted that the Tribunal disposed of only the instant claim petition despite the fact that out of the accident, there were other claim petitions filed in the Tribunal. It is therefore, submitted that the instant appeal may expedite. The request for expeditious hearing of the appeal shall be considered after sometime upon the application to that effect to be filed by the appellant.
