On 19.12.2011, this Court has passed the order which reads as under:
"Prima facie, it appears from the evidence at Exhibit-84 that the cheque was dishonored. However, Ms. Japee learned counsel for respondent no.5 requests for time. S.O to 22.12.2011.
Respondent no.1 herein has expired and the Death Certificate has been produced, which is taken on record. The legal heirs have been brought on record and therefore, their names be shown."
In view of the aforesaid,the civil application for bringing the heirs on record was required to be filed, but the same has not been done till date. Hence, the appeal is dismissed for default.
