Pursuant to the order dated 21.12.2009, the opposite party is present. Sri K.R. Singh, learned standing counsel has field an affidavit along with an application for discharge of the notice against the opposite party. It has been stated by Sri K.R. Singh that the opposite party is presently posted as the Deputy Commissioner, Commercial Tax, Division V, Meerut. This contempt application was filed in the year 2004 and ever since no impleadment applications have been filed for arraying the present officer posted at Aligarh. The opposite party was transferred in the year 2005 itself. However, it has been stated by Sri K.R. Singh that with regard to the compliance of the directions of this Court, which require the Assistant Commissioner to provide the certified copies of the assessment orders of various years as requested by the applicant, the appropriate authority at present would be the Assistant Commissioner, Commercial Tax. Division VIII, Aligarh.
Let a copy of this order be sent to the aforesaid officer by Sri K.R. Singh, learned standing counsel along with a copy of the contempt application. Whereupon it is expected that the said officer shall provide the necessary copies and make full compliance of the directions of this Court within period of one month. The applicant shall also approach the said authority for obtaining the certified copies of the assessment orders.
List in the week commencing 8.3.2010. On the said date an affidavit of compliance may be filed. Personal appearance of Sri K.N. Pal, Opposite Party is exempted till the next date.
