Heard learned counsel for the applicant.
The instant appeal has been filed assailing the order passed by Motor Accident Claims Tribunal.
While entertaining the instant appeal, this Hon'ble Court has been pleased to provide the appellant to deposit 50% of the awarded amount, which was deposited by the appellant in this Court. Subsequently, the appeal was dismissed by means of the judgment and order dated 01.12.2009 but as there was no order for withdrawal of the amount and as such, the instant application has been moved for withdrawing the amount which has been deposited in this Court in compliance of the order dated 06.03.2003. No objection has been filed against this application.
Accordingly, the application is allowed and the registry is directed to remit the amount deposited by the appellant to the Motor Accident Claims Tribunal, Lucknow within fifteen days from today, which, in turn, release the amount in favour of the claimants - respondents, after verification.
