ORDER IN FIRST APPEAL:
Having considered the submissions advanced by Mr. Nanavati learned advocate for the appellant so also considering the impugned judgment and award rendered by the Tribunal, the appeal requires consideration and hence, ADMITTED.
ORDER IN CIVIL APPLICATION:
Having considered the submissions advanced by Mr. Nanavaati learned advocate for the applicant-appellant Insurance Company so also considering the impugned judgment and award rendered by the Tribunal, Rule returnable on 8th October 2012. In the meanwhile, there shall be ad-interim stay in terms of Para-6(A) on the conditions that on or before returnable date, the applicant- appellant Insurance Company shall FA/2824/2012 2/2 ORDER deposit the entire awarded amount together with interest and proportionate costs with the concerned Tribunal.
