Heard learned counsel for the appellant.
The appellant-insurance company has preferred the present appeal under Section 30 of the Workmen's Compensation Act. Challenging the award dated 30.10.2006 passed by the Commissioner, Workmen's Compensation/Assistant Labour Commissioner, Shahjahanpur, whereby the The Tribunal has awarded Rs. 3,48,884/- along-with 7% interest as compensation to the claimants-respondents.
The only issue raised by the counsel for the appellant in the present appeal is that the insurance company is not liable to pay interest. The contention raised by the counsel for the appellant is covered by the judgment of the Apex Court in the case of Kamla Chaturvedi Vs. National Insurance Company & Ors. 2009 (1) AWC 509 (SC). Thus, the submission of the counsel for the appellant has no substance.
Consequently, the appeal lacks merit and is accordingly dismissed. There shall be no order as to costs.
