JUDGMENT / ORDER

Service of notice on the delay condonation application is sufficient in view of the office report. No one has put in appearance. No counter affidavit has been filed to oppose the delay condonation. The delay is of 47 days in filing the appeal. It is duly explained as per the affidavit filed in support of the application. The explanation so furnished has not been controverted.
Accordingly delay is condoned.
