JUDGMENT / ORDER

When the matter is taken up for hearing today, the learned Counsel for the appellant would submit that this Civil Miscellaneous Appeal has been filed only against the order of pay and recovery granted by the Tribunal. He would further submit that during the pendency of the appeal, the second respondent / the owner of the offending vehicle died and no steps have been taken to bring the legal representatives of the deceased till then.
2. The appeal of the year 2014 and since no steps have been taken to bring the legal representatives of the deceased second respondent, this Civil Miscellaneous Appeal is liable to be dismissed as abated. Accordingly the same is dismissed as abated. No costs. Consequently, the connected Miscellaneous Petition is also dismissed.
