JUDGMENT / ORDER

ORDER
1. Learned Counsel for the appellant states that the claimants have realised the compensation amount in execution of the impugned decree. Learned Counsel for the claimants/respondents, Smt. Kamla Misra, Advocate, however, states that the amount received by the claimants is short by Rs. 25,000/- (i.e. the amount which has been deposited by the appellant under Section 173 of the Motor Vehicles Act). A statement is made at the Bar that the claimants had applied for execution of the amount.
2. Since the claimants have put in appearance through their Counsel and were forced to contest the appeal in this Court, we deem it appropriate that out of Rs. 25,000/- deposited in this Court, a sum of Rs. 20,000/- be allowed to be withdrawn by the appellant and the remaining sum of Rs. 5,000/- shall be refunded to the claimants.
3. Subject to the above directions, the appeal stands dismissed as not pressed.
