Petition filed under Section 438 Cr.P.C. 2. Petitioner is the first accused in Crime No.251/14 of Balarmapuram Police Station, Thiruvananthapuram registered for the offences under Sections 143, 147, 148, 149 of IPC and Section 27 of the Arms Act.
3. The allegation against the petitioner is that on 2.3.2014 at about 8.45 pm he along with seven others were found threatening a crowd with a sword and attempting to assault them. When the police party led by S.I. of police noticed the offenders committing the offences, they took to their heels. They have thus committed the offences mentioned above. The submission of the learned counsel for the petitioner is that he is innocent and he may be granted bail, especially, in view of the fact that the second accused has been granted bail.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. The allegation against the petitioner is serious. He was found at a public place threatening the public with a sword. The submission of the learned counsel for the petitioner that the second accused has B.A.No.2868 OF 2014 :: 2 ::
been granted bail under Section 437 Cr.P.C. is not a ground to grant anticipatory bail to the petitioner. His detention will be necessary for effective investigation of the case. Accordingly, the prayer is rejected.
In the result, this Bail Application is dismissed.
