JUDGMENT / ORDER

----------------------- The petitioner is threatened with dispossession of the property in Survey No.62/1284 of Kannan Devan Hills Village covered by Ext.P1 and P2 documents, has approached this Court seeking an assignment of the land. The assignment of the land has been considered by the Revenue Divisional Officer. This Court already passed judgment in similar cases stating that in terms of Section 3 of the Kannan Devan Hills (Resumption of Lands) Act, 1971 (hereinafter referred to as the 'Act'), all the lands in Kannan Devan Hills Village is vested with the Government except certain exempted class. It is also held that assignment can be only granted for specific purposes as mentioned in Section 9 of the Act.
2. Therefore, application, if any filed by the petitioner shall be considered by the Revenue Divisional Officer in terms of the judgment of this Court, which is produced as Ext.P11. This shall be done within a period of four weeks from the date of receipt W.P.(C).No.18366 of 2014 2 of a copy of this judgment. No coercive steps shall be taken against the petitioner till the final decision is taken on assignment of the land. Once the decision is taken, it is found that the petitioner is not entitled for assignment, if the petitioner is found in occupation of any land, it is open for the authorities to take action against the petitioner to evict them from the land.
The writ petition is disposed of as above.
