JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)
1. The present application is filed by the convict through his mother seeking temporary bail for a period of 60 days so as to undertake agricultural operation and to arrange for the livelihood of the family.
2. Rule.
Mr. Patel learned APP waives service of rule on behalf of the respondent-State.
3. The applicant has been convicted for the offences punishable under section 302, 504 and 34 of IPC for life imprisonment as awarded vide judgment and order dated 30.3.2010 Sessions Case No. 79/2008. By now, he has undergone 3 years, 6 months and 27 days as on 23.6.2012. He has enjoyed temporary bail on four occasions and one furlough and every time reported in time. Nothing adverse is reported against the convict.
4. Taking into consideration the contents of the application, the same is allowed. The present applicant-convict is ordered to be released on temporary bail for a period of 30 days from the date of his release on his executing a personal bond of Rs. 5000/- (Rupees five thousand only) to the satisfaction of the Jail authorities.
5. The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute.
