1. Present application is filed by the wife of the convict - under trial prisoner. The convict is arrested on 08.08.2009 for the offence under section 304 and 302 of the IPC in connection with C.R.No.I-252 of 2009 registered with Odhav Police Station.
2. Party in person makes available order dated 05.08.2011 passed by this Court in Criminal Misc. Application No.11088 of 2011, whereby this Court was pleased to extend time of temporary bail for a period of three weeks.
3. Rule.
Learned Additional Public Prosecutor Mr.H.K.Patel waives service of process of Rule.
4. Taking into consideration the contents in the application, the application is allowed. The convict is ordered to be released on temporary bail for a period of 3o days from the date of his release, on his executing personal bond of Rs.10,000/- (Rupees ten Thousand only) to the satisfaction of the jail authorities and on condition that the convict shall mark his presence before the nearest Police Station every alternate day where he shall stay and the convict shall not leave local limits of Ahmedabad during the temporary bail period.
5. The convict shall surrender to the jail authorities on expiry of the temporary bail period.
6. Rule is made absolute to the aforesaid extent.
