Heard learned counsel for the plaintiff-applicant.
In view of the order, which is proposed to be passed, notices need not go to the private respondents.
The applicant has approached this Court to expedite the proceedings of Original Suit No.180 of 1983 (Moinuddin Khan vs. Shri Madan Mohan and others) pending before learned Civil Judge (Senior Division) Hathras.
Learned counsel for the petitioner states that initially the aforesaid suit was filed by the father of the petitioner in the Court of Civil Judge (Senior Division), Aligarh on 1.5.1983 and the same was registered as Original Suit No.180 of 1983. After bifurcation of district Aligarh, a new district Hathras has been carved out and the matter has been transferred to district Hathras. In the aforesaid suit the issues were framed in the year 1984 itself and since then either on one reason or on the other the suit proceeding has not been finalized.
In the facts and circumstances, the Court has proceeded to examine the record in question as well as the ordersheet, which is appended alongwith the writ petition and is of the opinion that the present suit may be treated as one of the oldest matter in District Hathras and the trial court will try to finalise the proceeding of the aforesaid suit in accordance with law, as expeditiously as possible and preferably within one year from the date of production of certified copy of this order, without granting unnecessary adjournment to either of the parties, except upon payment of cost.
The writ petition stands disposed of.
