Learned counsel for the petitioner is permitted to describe respondent No.3 as Tehsildar Sadar, District-Muzaffarnagar.
Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The petitioner wants that his representation to the Tehsildar be decided within a time-bound period. In the representation, petitioner want that the nuisance arising out of the running of an electric motor in a residential premises be removed.
If that be so, the petitioner has an alternative remedy under Section 133 Cr.P.C. to get the nuisance removed by moving an application before the District Magistrate or a Sub Divisional Magistrate or any other Executive Magistrate empowered in that behalf.
In view of the above, we dispose of the petition with liberty to the petitioner to file an appropriate application before the authority concerned, which shall be considered in accordance with law most expeditiously.
The writ petition stands disposed of.
