Petition under Section 438 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioners on bail in the event of their arrest in connection with Crime No. 26 of 2014 of P.S. Kotagiri, Nizamabad District.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri D. Bhaskar Reddy, Advocate for the Petitioners and of the Public Prosecutor on behalf of Respondent- State, the Court made the following ORDER:-
“Heard both sides.
This petition under Section 438 of the Code of Criminal Procedure is filed by the petitioners-A.2 and A.3 for their release in the event of their arrest in connection with crime No.26 of 2014 of Kotagiri Police Station, Nizamabad District, registered for an offence punishable under Sections 498A, 406 and 306 of Indian Penal Code.
The allegations, in brief, are that having married the deceased Farjana Begum, the non-petitioner i.e. A.1 along with the petitioners herein, who are his parents, subjected the deceased to harassment. Being unable to bear the same, deceased alleged to have committed suicide on 21.02.2014.
A perusal of the material on record shows that there are no specific allegations against the petitioners as in the case of A.1, who has been arrested, remanded to judicial custody and also released on bail. Petitioners are aged about more than 60 years and they are said to be the parents of A.1.

Considering the above, this petition is allowed and the petitioners-
A.2 and A.3 are directed to surrender before jurisdictional Magistrate concerned i.e. Judicial First Class Magistrate, Bodhan, within two weeks from today and on such surrender they shall be enlarged on bail on their executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for the likesum each to the satisfaction of the said Magistrate. Further, they are directed to appear before the investigation officer as and when required and co- operate with the investigation agency during enquiry.”
