1. Heard Sri Satish Dwivedi, learned counsel for petitioner and Sri Devendra Tripathi, learned counsel for respondents.
2. The sole prayer made in writ petition is that petitioner's statutory appeal preferred before respondent 2 i.e. Inspector General, Railway Protection Force, Northern Railway, New Delhi vide Departmental Appeal dated 19.08.1997 be decided.
3. Learned counsel for respondents has filed counter affidavit and it is said that file relating to petitioner is not traceable.
4. Be that as it may. It is open to competent authority to treat copy of appeal filed by petitioner before this Court as memo of appeal and decide the same on merits.
5. Writ petition is disposed of directing respondents to decide appeal of petitioner by means of a speaking order, within two months from the date of production of a certified copy of this order along with copy of aforesaid appeal.
