Petitioner is the 5th accused in Crime No.461 of 2013 of the Mannarkad Police Station for the offences punishable under Sections 409, 420 and 120B read with Sec.34 of the Indian Penal Code, apprehends arrest and has filed this application. 2. Learned Public Prosecutor has opposed the application.
It is submitted that petitioner is the collecting agent of the Co- operative Bank referred to in the case while some of the other accused are officials of that Bank. Allegation is that the petitioner and others, pursuant to a criminal conspiracy availed loans on the security of spurious gold ornaments. Total amount involved is Rs.87,16,800/-. So far as the petitioner is concerned, it is submitted that two gold loans were availed in his name without pledging any gold ornament and the amount involved is Rs.18,.20,000/-. Petitioner also was a party to the conspiracy.
3. Learned counsel submitted that the allegations against the petitioner are not correct. His job was only to collect money as an agent.

4. Accused 7 and 10 in the case had approached this court in B.A. No.2150 of 2014. They were also collecting agents of the Bank. This Court found that their request for pre-arrest bail cannot be allowed.
5. On hearing both sides I do not find reason to take a different view in the matter. Hence the request for pre-arrest bail cannot be allowed.
6. Petitioner shall surrender before the Officer investigating the case on 18.06.2014 and on other dates as directed by the said Officer. In case the petitioner is arrested, he shall be produced before the jurisdictional magistrate as early as possible.
Application is disposed of as above.
