1. Heard learned Advocate Mr. O.K. Barot on behalf of the applicant and learned Additional Public Prosecutor Mr. R. C Kodekar on behalf of the respondents.
2. Rule. Learned APP waives service of Rule on behalf of the respondents.
3. By way of this application, the applicant convict prays for being released on parole leave for the purpose of providing financial assistance to his family.
4. Jail remarks show that the applicant had been convicted for offences punishable under Section 302 of the Indian Penal Code amongst other offences and sentenced to life imprisonment. Jail remarks would show that the applicant has undergone incarceration for approximately 14 years and 05 Page 1 of 2 Downloaded on : Fri Apr 21 20:54:44 IST 2023 R/SCR.A/5089/2023 ORDER DATED: 21/04/2023 months imprisonment as of now. Jail remarks also show that the applicant had been lastly released on furlough leave in the month of January 2023 and on parole leave in the month of July 2022 for a period of 7 days. It also appears that as and when released earlier, the applicant has scrupulously surrendered in time. Jail conduct of the applicant is also stated to be good.
5. Considering the same more particularly the period of incarceration undergone by the applicant and the jail conduct of the applicant, this Court is inclined to allow this application. The applicant is directed to be released on parole leave for a period of 30 days from the date of actual release on executing personal bond of Rs.10,000/- (Rupees Ten Thousand) before the Jail authority and on usual terms and conditions as may be imposed by the Jail Authority.
The applicant convict to surrender before Jail Authority on completion of parole leave, without fail. Rule is made absolute to the aforesaid extent.
