On instructions from the concerned Police Officer, learned APP has submitted that the petitioner may remain present before the concerned Police Officer/Investigating Officer on 2nd January, 2013, 3rd January, 2013 and 4th January, 2013 from 11:00 a.m. to 5:00 p.m. Learned counsel for petitioner has assured the Court that the petitioner will remain present before the Investigating Officer, as instructed, i.e. from 11:00 a.m. to 5:00 p.m. on 2nd January, 2013, 3rd January, 2013 and 4th January, 2013.
In view of the said submissions and assurance, let Notice be issued returnable on 10.01.2013. Until then the arrangement made vide order dated 24.12.2012 will continue subject to aforesaid condition. It is clarified that if the petitioner commits breach of the Page 1 of 2 R/SCR.A/3521/2012 ORDER aforesaid assurance and condition even on single occasion then the operation of this order shall stand automatically cease/discontinue. In addition to normal mode of service through office, direct service is permitted.
