WRIT PETITION No.13511 of 2014 ORDER:
The petitioner claims to be the purchaser of land to an extent of Ac.2.58 cents in Survey No.258/A and Ac.0.13 cents in Survey No.258/B of Rayalacheruvu Village, Yadiki Mandal, Anantapur District. When the deed of conveyance was presented for registration on 03.02.2014, the Sub-Registrar, Yadiki Mandal (third respondent) has received the same and assigned P.No.1/2014. But, so far neither the document is released nor reasons are assigned as to why the document is kept pending. On account of the inordinate delay in processing the document, grave prejudice is caused to the petitioner.
The learned counsel for the petitioner submits that earlier the petitioner’s vendor filed W.P.No.7754 of 2013 and the same was disposed of by this Court with a direction to receive and process the document without insisting upon production of No Objection Certificate from the Revenue Authorities; that pursuant to the said order of this Court, the petitioner and his vendor presented the document for registration, and that though the third respondent received the document, he kept the same pending without assigning any reasons.
Having regard to the submissions made, without expressing any opinion on merits, the Writ Petition is disposed of directing the Sub-Registrar, Yadiki Mandal (third respondent) to process the document bearing P.No.1/2014 if the same is in accordance with the Registration Act, 1908, and the Indian Stamp Act, 1899; and if the document cannot be processed for registration, the 4th respondent shall assign reasons and communicate the same to the petitioner within two weeks from the date of receipt of a copy of this order. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed.
