HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 28264 of 2014 ORDER :
Pursuant to the advertisement issued on 21.10.2011 for enlistment of retail petroleum outlet dealership on the road from Miryalaguda to Nagarjunasagar X road towards Addanki, the petitioner herein and another person are short listed and petitioner was shown as first enlisted candidate. Merit panel was published on 5.10.2012. Grievance of the petitioner necessitating institution of this writ petition is that even though merit panel was approved and published on 5.10.2012, no further action was taken to award the dealership and there was no further communication to the petitioner.
2. When the matter is taken up, Sri Toom Srinivas, learned counsel appearing for respondent corporation on instructions submitted that second empanelled candidate complained against marks awarded to petitioner and based on the said complaint investigation was initiated and further action pursuant to merit panel dated 5.10.2012 was not taken. However, learned standing counsel in unable to explain the reasons for such delay of almost two years for taking further action in the matter.
3. As agreed by both counsel, in the facts of the case without expressing any opinion on the merits of the matter, writ petition is disposed of directing the respondent corporation to complete the investigation into the allegations leveled by the second empanelled candidate within a period of three months. If necessary before passing final orders, petitioner shall also be put on notice and be given opportunity of hearing and to place relevant material in support of his claim on record. No costs. Sequel to the same, miscellaneous petitions, if any stand dismissed.
