Heard learned counsel for the applicant, learned Additional Government Advocate for the State/opposite party no.1 and perused the record with the assistance of learned counsel for the parties.
This application under Section 482 Cr.P.C. has been filed by the applicant for a direction to the court below to decide the trial being Case No. 2707-A of 2017 (State vs Nankula and others) arising out of Case Crime No. 89 of 2016, under sections 498- A, 304-B IPC and section 3/4 of Dowry Prohibition Act, police station Kaushambi, district Kaushambi pending in the court of Chief Judicial Magistrate, Kaushambi, as expeditiously as possible.
At the very outset learned counsel for the applicant submitted that on account of some defects, he does not want to press this application at this stage and he may be permitted to withdraw this application with liberty to file afresh at the appropriate stage with better particulars.
In view of submission made by Mr. Sanjay Kumar Prajapati, learned counsel for the applicant, this application under section 482 Cr.P.C. is dismissed as withdrawn with the aforesaid liberty.
Office is directed to return the certified copy, if any, to the learned counsel for the applicant, if so desires, after retaining photostat copy of the same on record as per rules.
