Order: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta)
At this stage, we are not inclined to interfere with this matter as it is not the case of the writ petitioner that the Superintendent has no jurisdiction to issue the impugned show cause notice. Therefore, we permit the writ petitioner to place its case before the aforesaid Officer and the case which will be produced by the writ petitioner must be considered by him with reasons, in accordance with law. It must be completed within a period of four weeks from the date of submitting explanation to the show cause notice. The petitioner shall submit its explanation to the show cause notice within a period of a fortnight from the date of receipt of a copy of this order. If no explanation is submitted by the petitioner within the aforesaid period, it would be open for the aforesaid Officer to proceed in accordance with law.
The writ petition is accordingly disposed of.
Consequently, the miscellaneous applications, if any pending, shall also stand closed. No order as to costs.
