Learned counsels have advanced submissions at length on merit for vacating the interim relief and saving interim relief in Civil Application No. 5777 of 2012.
The court is of the view that matter deserves consideration. Hence, Rule returnable on 21.08.2012. Ms. Raval, learned AGP waives service of notice of Rule on behalf of respondent No. 1 and Mr. Meena, learned advocate waives service of Rule on behalf of respondent No.2 - GIDC. As this Court has already in dismissed the Civil Application No. 5777 of 2012 which was preferred for vacation of interim relief, the ad-interim relief granted earlier is confirmed. Prima-facie there exists justification for granting relief in addition to earlier relief that respondent no. 2 shall not insist upon the payment of notice charges from occupants till final disposal of this petition.
