When the matter is called out, learned advocate Mr.Nishith P. Thakkar for the appellants is not present.
Learned advocate Mr. Nasir Saiyed for the respondents appearing on caveat has stated that though on earlier occasion it has been recorded in the order dated 08/10/2012 that learned advocate for the appellant will submit the paper book, he has not been supplied with any papers. He has also stated that delay was also condoned when he was not present.
In the facts of the case, the matter is ordered to be posted only after the copy is served to learned advocate Mr.Nasir Saiyed who appears for respondent on caveat.
The matter may be placed after taking instruction with regard to supply of the copy and the office will place it on record after such verification.
