(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) The petition is admittedly based upon a contract and claims refund of security deposit by way of main relief. Admittedly even copy of the contract between the parties is not placed on record and alternative remedy of filing a civil suit for proving petitioner's case is available. Therefore, the petition is dismissed in limine only on the ground of availability of alternative remedy without entering into the merits of contentions of the petitioner.
