(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) Heard learned counsel Mr.B.S.Patel for the appellant, learned counsel Mr.G.M.Joshi for the respondents No.1 to 6 and learned Government Pleader Mr.P.K.Jani assisted by learned AGP Mr.Rashesh Rindani for the State.
Learned counsel Mr.Patel for the appellant has urged that the direction issued by the learned Single Judge for taking action against the appellant could not be issued by the learned Single Judge. Prima facie, we find force in the submission of learned counsel for the appellant. Learned counsel Mr.G.M.Joshi states that he wants to argue the matter, and therefore, we fix this matter on 16th April, 2012. The effect and operation of the order dated 20.12.2011/22.12.2011 passed by the learned Single Judge in Civil Application - For Orders No.5191 of 2011 in Special Civil Application No.16616 of 2010 shall remain stayed till then.
Learned counsel Mr.G.M.Joshi shall file affidavit-in-reply by 09th April, 2012, and affidavit-in-rejoinder shall be filed by learned counsel for the appellant by 13th April, 2012.
List this matter for admission/final disposal on 16th April, 2012. Direct service is permitted.
