JUDGMENT / ORDER

In Paragraph No.5(iii) of the affidavit-in-reply filed on behalf of respondent No.2, it is mentioned as under:-
"(iii) that, the plaintiff and the defendants are permanent residents of Mudra Taluka. The suit was transferred from the learned Civil Judge, who had decided the earlier application for joining party, on administrative ground on appointment of a new Civil Judge, I.e.5th Senior Civil Judge, Bhuj."
In view of the aforesaid statement made by the respondent No.2, the apprehension put forward is not survived.
The application is disposed of. Liberty is reserved to approach, in case of difficulties.
