1. Heard Mr. H.G.S. Parihar, Senior Advocate, assisted by Mr. Alok Yadav for the petitioner as well as Learned Additional Chief Standing Counsel for the State.
2. Notice on behalf of opposite parties has been accepted by the learned Chief Standing Counsel.
3. This writ petition has been filed seeking following reliefs:-
"1. Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to provide permanent adequate free security over to the petitioner forthwith.
2. Issue a writ, order or direction in the nature which this Hon'ble High Court deems fit and proper in the circumstances of the case, in favour of the petitioner.
3. Cost of the Writ Petition may be awarded in favour of the petitioner."
4. Learned counsel for the petitioner submits that there is a threat to the life of the petitioner as being a witness in Case Crime No.467 of 1993, under Sections 147, 148, 149, 307 IPC, Police Station Nawabganj, District Gonda against Brij Bhushan Sharan Singh, MP.
5. We have considered the submissions made by the learned counsel for the petitioner and gone through the record.
6. We are of the view that in case the petitioner applies for security in accordance with procedure prescribed, then the opposite parties shall consider and do the needful in accordance with law.
7. We direct the Superintendent of Police, Gonda to ensure security of the petitioner on the date(s) when his statement is recorded in the court in the aforesaid case. The petitioner is required to intimate the date before the trial court for his evidence to the Superintendent of Police, Gonda.
8. With the above observation, the writ petition is disposed of.
