Petitioner was granted compassionate appointment on the post of Follower in 1994. His grievance is that he was subsequently appointed on the post of constable on compassionate ground but he is not being allowed to join.
Learned Standing Counsel points out that the petitioner was appointed on the post of Follower and there is nothing on record to show that he was, infact, appointed on the post of Constable. It is also stated that once the petitioner was appointed on the post of Follower, it was not possible to promote him to the post of Constable, in the absence of an enabling provision.
Admittedly, petitioner was granted compassionate appointment in 1994 on the post of Follower. There is nothing on record which may indicate that such appointee would claim higher post subsequently. Except some correspondence, there is nothing on record to show that the petitioner was appointed as Constable. Such query of the petitioner has otherwise been replied, stating that there is no proposal to appoint the petitioner as constable. In such circumstances, no direction could be issued, as is prayer for, in the present writ petition.
Writ petition is accordingly dismissed.
