Heard Sri Sudhir Kumar Singh, learned counsel for the petitioner, Sri G.P. Singh, learned A.G.A. appearing for the State and perused the impugned F.I.R. as well as material brought on record.
The relief sought in this petition is for a direction to respondent nos. 1 to 4 to pay all the medical expenses which were borne by the petitioner/accused during his jail period.
Learned AGA opposed the prayer and submits that petitioner has approached this Court earlier for the same cause of action in Crl. Misc. Writ Petition No. 19586 of 2016 and the said petition was disposed of by this Court on 05.09.2016 to which learned counsel for the petitioner submits that petitioner obtained the said order of this Court on 05.10.2016 by the Registry but no action was taken by them in pursuance of the order of this Court passed on 05.09.2016, hence, he filed the present petition again.
Considering the fact that the present petition is not maintainable for the same cause of action, the same is dismissed on this ground alone with liberty to avail legal remedy as available.
