Heard Sri Arvind Kumar Rai holding brief of Sri Sunil Kumar Yadav, learned counsel for the petitioner and the learned Standing Counsel for the State-Respondents.
The petitioner in the writ petition is seeking a direction to the respondent no.2 to decide the Case No.02 of 2018 (Narendra Pal and another Vs. Gram Panchayat Secretary, Gram Panchayat Badagaon, Etah) pending under Section 95-1 (G) of the Uttar Pradesh Panchayat Raj Act, 1947 sated to have been filed by the petitioner on 09.12.2017. Copy of the ordersheet has been filed as Annexure-4 to the writ petition.
No useful purpose would be served by keeping this writ petition pending.
This writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with a direction to the respondent no.2, District Magistrate, Etah to consider and decide the Case No.02 of 2018 (Narendra Pal and another Vs. Gram Panchayat Secretary, Gram Panchayat Badagaon, Etah) in accordance with law within a period of four months from the date a certified copy of this order is received in his office.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
