The learned Trial Court issued a temporary injunction in favour of the plaintiff/petitioner injuncting the defendant/respondent from interfering with the possession of the petitioner. The learned appellate court reversed the order of the learned Trial Court by the judgment and decree dated 27.05.2019.
Sri Ramendra Asthana, learned counsel for the petitioner contends that the learned appellate court has found that the appellate court can determine the correctness of the stand taken by the parties only after tendering of evidence.
Learned counsel for the petitioner contends that the petitioner is relying on the sale deed of 1998 and hence the finding is perverse.
Matter needs consideration. Issue notice to respondent no. 2.
The respondents may file counter affidavit.
Till the next date of listing status quo between the parties shall be maintained.
List on 31.07.2019 before the appropriate Bench.
