This application for appointment of arbitrator has been moved by the petitioners saying that a dispute has arisen between the partners of the firm with respect to the claim of the petitioners on the dissolution of partnership firm.
Heard learned counsel for the petitioners Sri S.K.Mehrotra and Sri S.P.Shukla for the respondents.
There appears to be a dispute between the petitioners and the respondents with respect to the settlement of the claims of the parties on dissolution of the partnership firm. Notice was given to the petitioners for appointment of the arbitrator but the arbitrator was not appointed. During pendency of this case, the case was got adjourned on number of times on the ground that the dispute is likely to be settled outside the Court, but today, a statement has been made by learned counsel for both the parties that the dispute could not be settled and, therefore, an arbitrator be appointed.
As prayed by learned counsel for the parties, Hon'ble Mr. Justice O.P.Srivastava (Retd.) is appointed as Arbitrator subject to his consent and convenience.
The application is disposed of accordingly.
