Heard learned counsel for the applicant and learned AGA for the State.
The present 482 Cr.P.C. application has been filed to quash the criminal proceeding of criminal case No.1856 of 2018 (State of U.P. Vs. Narendra Kumar) arising out of Case Crime No.0593 of 2017, under Section 379 I.P.C., Police Station Sasani Gate, District Aligarh pending in the Court of Additional Chief Judicial Magistrate, II, Aligarh.
Learned counsel for the applicant submits that he has been falsely implicated by the police under the alleged sections.
In that view of the matter, he is permitted to move discharge application through counsel before the trial Court within a period of three weeks and the trial court shall decide the same within a period of one month from the date of production of a certified copy of this order along with application.
Till the discharge application is decided, no coercive measures shall be taken against the applicant.
With the aforesaid directions, application stands disposed of.
