Heard learned counsel for the petitioner and perused the record.
Present petition has been filed challenging the impugned order dated 28.8.2018 passed by Principal Judge, Family Court, Kanpur Nagar under Section 24 of Hindu Marriage Act.
The aforesaid order has been passed under Section 24 of the Hindu Marriage Act. As per Full Bench decision of this Court in Kiran Bala Srivastava vs. Jai Prakash Srivastava, 2006 Alld. C.J. 1936, the appeal under Section 19 of the Family Courts Act, 1984 is maintainable.
A reference may also be made to a decision in Yogish Arora vs. Smt. Jennette Yogish Arora @ Miss Jennettee Dsouza, 2018 (9) ADJ 379.
Present petition is accordingly dismissed on the availability of alternative remedy.
Office is directed to return the certified copy of the impugned order after retaining the photocopy of the same.
