After some arguments, a prayer has been made by the counsel for the petitioner to direct the court below namely Civil Judge (Junior Division) Jyotiba Phule Nagar/ Amroha to pass appropriate orders on the application no. 3 (ग) as directed vide order dated 16.08.2021 passed in Misc. Appeal No. 9 of 2020 (Narendra Kumar Trivedi Vs. Ashok Kumar Kaushik and others).
Heard counsel for the petitioner, Shri Sandeep Kumar Singh and Shri Anadi Krishna Narayana, learned counsels appearing on behalf of respondent no. 2 and Shri V.P. Srivastava, learned counsel for respondent no. 3.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of four months from the date of production of copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
