Heard learned counsel for the petitioner and learned Standing Counsel. Shri A.K. Yadav appears for respondent nos.2 to 4.
The petitioner is before this Court for a direction to second respondent to extend the benefit of reservation to the petitioner under the category of ex-serviceman in the selection process, which is going on for the post of Lecturer (History).
Learned counsel for the petitioner submits that the controversy in hand is squarely covered by the judgments passed in Writ Petition No.28737 of 1997 (Ram Chandra Chaudhary v. State of U.P. & Ors.) decided on 8.5.1998; Writ Petition No.4032 of 1993 (Markendey Rai v. State of U.P. & Ors. decided on 9.1.1998 and Special Appeal No.40 of 1991 (Hari Shankar Upadhyay v. Public Service Commission, U.P., Allahabad) decided on 9.12.1997 and as such similar indulgence may also be accorded in this writ petition also.
Considering the facts and circumstances of the case and with the consent of learned counsel for the parties, the writ petition stands disposed of with observation that in case petitioner moves fresh representation ventilating his grievances before the second respondent i.e. U.P. Secondary Education Service Selection Board, U.P. at Allahabad through its Secretary within two weeks, this Court hope and trust that the same would be decided in accordance with law and in the light of the aforesaid judgments by speaking order expeditiously and preferably within two months from the date of filing of such representation.
