The prayer made in this petition is to restrain the respondents from harassing the petitioner.
It appears from the record that son of the petitioner is an accused of Case Crime No. 71 of 2019 which has been registered at Police Station Kotwali, District Gorakhpur under Section 406 I.P.C. and in connection therewith the police is inquiring from the petitioner.
On a pointed query whether petitioner's son has surrendered and obtained bail, the learned counsel for the petitioner states that to the best of his knowledge he has not yet surrendered.
Under the circumstances, if the police is inquiring about the petitioner's son, who is an accused, such inquiry cannot be termed harassment. However, if the property of the petitioner is attached, it will always be open to the petitioner to represent to the concerned Magistrate.
