The prayer made in this petition is to restrain the respondents from harassing the petitioner.
It appears from the record that son of the petitioner is an accused of Case Crime No. 284 of 2018 which has been registered at Police Station-Kotwali,, District-Gorakhpur under Section 419, 420, 406, 467, 468, 471 I.P.C. and in connection with his arrest the police has obtained non-bailable warrants and has initiated proceedings under Section 82 and 83 Cr.P.C.
On a pointed query whether petitioner's son has surrendered and obtained bail, the learned counsel for the petitioner states that to the best of his knowledge he has not yet surrendered.
Under the circumstances, if the police is inquiring about the petitioner's son, who is an accused, such inquiry cannot be termed harassment. However, if the property of the petitioner is attached, it will always be open to the petitioner to represent to the concerned Magistrate.
