By order dated 31.7.2019, the case was directed to be listed peremptorily and was so listed on 14.8.2019. However, on the said date, the Members of the Bar were abstaining from judicial work and, therefore, the case was again directed to be listed peremptorily on 21.8.2019. The case was again listed peremptorily on 21.8.2019 on which date the counsel for the petitioners requested that the case may be adjourned for today, i.e., 26.8.2019. On the request of the counsel for the petitioners, the case has been listed in the additional cause list today. On behalf of the counsel for the petitioners, a prayer for adjournment has been made. The prayer for adjournment is rejected.
I have perused the records of the case.
The present writ petition has been filed against an order dated 14.6.2012 passed by the Consolidation Commissioner, Uttar Pradesh at Lucknow holding that it was appropriate that a notification under Section 6(1) of the Uttar Pradesh Consolidation of Holdings Act, 1953 (hereinafter referred to as, 'Act 1953') be issued cancelling the notification issued under Section 4 of the Act, 1953.
In view of the Division Bench judgments of this Court reported in Dalip Singh & Ors. Vs. Vikram Singh & Ors. (2015) 128 RD 666 and Agricultural & Industrial Syndicate Ltd. Vs. State of U.P. (1976) RD 34, the writ petition is not maintainable and the reliefs prayed for cannot be granted. The writ petition is, therefore, dismissed.
