JUDGMENT / ORDER

By the impugned order dated 8.1.2014 passed by the Dy. Director of Consolidation, Sitapur, camp at Lakhimpur Khiri, in Revision No. 380/2012: Narendra Kaur Vs. Tarsem and others, the parties have been directed to appear before the Consolidation Officer, Lakhimpur on 13.2.2014. It has been stated that at the Bar by the learned counsel for the petitioner that the entire evidence, to be filed by both the parties, has been filed and is on record.
In view of the statement made, without entering into the merits of the controversy between the parties, it is directed that the Consolidation Officer, Record Operations I, Lakhimpur, before whom the matter is pending and before whom the parties have been directed to appear in pursuance to the order impugned shall endeavour to decide the case within a period of 3 months from the date of production of a certified copy of this order before him.
It is made clear that unnecessary adjournments shall not be granted to either of the parties, and, in case need arises, the Consolidation Officer shall proceed to hear the matter on day-to-day basis.
At this juncture, it has been submitted by the learned counsel for the petitioner that he is being threatened with dispossession. He, therefore, prays for an order of status quo.
This Court is not inclined to grant any interim protection to the petitioner. However, it is provided that in case the petitioner appears before the Consolidation Officer on or before 26.2.2014 along with a certified copy of this order, as also an application for interim protection, the Consolidation Oficer shall consider the application for interim protection and pass appropriate orders thereon within a period of 10 days thereafter. In this context, learned counsel for the respondent, Sri J.P. Maurya, who represents respondent nos. 3 to 6 has assured this Court that his clients shall not take any steps for dispossessing the petitioner till the date fixed for appearance of the petitioner, i.e. 26.2.2014.
It is made clear that this Court has not examined the matter on merits and the Consolidation Officer shall deal with the same on merits without being influenced by any observation made hereinabove.
With the aforesaid directions, the writ petition stands disposed of.
