Heard learned counsel for the applicant and the learned A.G.A. And perused the record.
It is submitted by learned counsel for the applicant that in the present case four persons including the applicant are named in the F.I.R. According to the F.I.R. the main role is attributed to the co-accused Smt. Prema and his brother Bhaiya Lal. It is alleged that the applicant and other co-accused persons committed the murder of the deceased by putting on hanging but the co-accused Bhaiya Lal, whose case is on the same footing and Smt. Saroj whose case is also on the same footing with the applicant has been released on bail by another bench of this court on 6.8.2010 in criminal misc. bail application no. 20777 of 2010. The prayer for bail of Smt. Prema has been refused, therefore, the applicant may be released on bail. The applicant is in jail since 10.2.2011.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Narendra alias Baura involved in case crime no. 158 of 2010 under Section 302 I.P.C., P.S. Naubasta District Kanpur Nagar be released on bail on his furnishing a personal bond and two heavy sureties to the satisfaction of the Court concerned with the condition.
That the applicant shall not tamper with the evidence.
That he shall report to the court of C.J.M. concerned in the first week of each month to show his good conduct and behaviour till conclusion of the trial.
In case of default in any of the above mentioned conditions, the bail granted to the applicant shall be deemed cancelled and he shall be taken into custody forthwith.
